CASE COUNTY CIRCUT COURT GRANTS COMPLETE DISMISSAL OF ZONING CASE

The plaintiff filed a multi-count complaint against the Village of Cassopolis, including claims asserting promissory estoppel, breach of contract, takings, and gross negligence, arising out of the Village’s denial of a variance for a recycling facility in an industrial park. In dismissing the case, the trial court concluded that the plaintiff did not have a viable takings claim, and that the other allegations fell within the scope of an administrative appeal, which the plaintiff neither initiated nor pursued. The Village of Cassopolis was represented by McGraw Morris P.C. attorney Craig R. Noland.
