FEDERAL COURT GRANTS COMPLETE DISMISSAL OF RESIDENTS’ RACIAL DISCRIMINATION CLAIMS.

On May 23, 2012, the Federal District Court for the Eastern District of Michigan granted the complete dismissal of a lawsuit filed against the City of Grosse Pointe Park and several other municipal defendants. The City was defended by McGraw Morris P.C. attorneys, Thomas J. McGraw and Christopher J. Raiti. As reported in the Detroit Free Press, Plaintiffs claimed that the City of Grosse Pointe Park, the City of Grosse Pointe Farms, the Grosse Pointe Public School System, and its Residency Investigator conspired to discriminate against Plaintiffs and their minor children, resulting in their exclusion from the Grosse Pointe Public School System. Plaintiffs alleged that the City of Grosse Pointe Park initiated a gang investigation at the request of the Grosse Pointe Public Schools System as a pretext to brand Plaintiffs’ children as gang members because of their race, which led to a residency investigation. Plaintiffs claim that the residency investigation was also racially motivated and that the School System denied Plaintiffs the opportunity to prove their residency. The Court disagreed and ruled that none of the actions taken by the Defendants were unconstitutional and that Plaintiffs failed to demonstrate that their race played any role in any of the decisions or actions by any of the Defendants.
