Village of Elkton Chief of Police Fully Vindicated By United States District Court In Excessive Force Case

On October 4, 2012, Village of Elkton Police Chief Scott Jobes was fully vindicated by the United States District Court for the Eastern District of Michigan, Northern Division, in a lawsuit filed by Grant Toner alleging excessive force. Chief Jobes and the Village of Elkton were successfully defended by McGraw Morris P.C. attorney G. Gus Morris. Click here to read the frontpage article in Michigan Lawyers Weekly regarding the victory. On October 19, 2008, Plaintiff was arrested for drunk driving when he was spotted driving erratically. Plaintiff failed sobriety tests and blew a .16 on the PBT. Plaintiff alleged in the lawsuit that Chief Jobes used excessive force when handcuffing him and when placing him into the patrol car. Despite Plaintiff’s allegations, the entire stop was recorded, and that recording blatantly contradicted Plaintiff’s versions of events. In dismissing Plaintiff’s lawsuit, the court noted that the only information that “cast doubt” on the Chief’s professionalism was Plaintiff’s own self-serving statements. However, because those self-serving statements were “blatantly contradicted” by the police car recording, Plaintiff’s version of the stop was not considered and Plaintiff could not demonstrate that his constitutional rights were violated.
